Article by Dean of Faculty of Law Cited by Judges in Foreign Rulings

The Dean of the Faculty of Law, Javier Junceda, has once again established doctrine beyond our borders. This time, the Supreme Court of Peru has turned to one of his articles to resolve disciplinary proceedings.

This is the third time that overseas jurisdictions have based their arguments on articles by the Dean. In this case, two judges of the Supreme Court of Peru, in two disciplinary proceedings against a judge and a legal secretary, based their dissenting votes on the work “Los principios de proporcionalidad y prescriptibilidad sancionadores” (“The Principles of Proportionality and the End of Sanctions”), which was published in Documentación Administrativa, a journal issued by the Spanish government.

In the past, the Court of Cochabamba in Bolivia and the Constitutional Court of Chile have cited articles by Dr. Junceda on environmental law and criminal law in the field of traffic, respectively.
