Lecturer Ricardo-María Jiménez analyses how to better draft judicial decisions

Ricardo-María Jiménez, lecturer at the Faculty of Law and the Faculty of Humanities at UIC Barcelona, has published an article in the journal InDret, written together with Supreme Court Judge Ignacio Sancho Gargallo on how to better draft judicial decisions. Under the title “Resoluciones judiciales correctas, claras y precisas” (Correct, clear and precise judicial decisions), the authors present a series of guidelines and suggestions for improving the drafting of these legal texts so that they are in line with the correctness, clarity and precision of the justice of the decision.

Thinking before writing, writing short paragraphs, using the active voice, correctly using the gerund and choosing the right words, are just some of the topics discussed in the article, which stresses that the leading role of judicial decisions in the proper use of legal language lies primarily with the Supreme Court, as they generate case law.

“The communication skills needed by judges must be acquired at the beginning of their training and maintained throughout their career”, said Ricardo-María Jiménez.
